The European Commission's plan to rewrite the EU's water protection law to expedite critical minerals mining in water-stressed regions has sparked alarm. Mining, a water-intensive industry, demands significant volumes for ore processing, dust suppression, waste management, and dewatering. While modern projects recycle water, they still require substantial amounts, which can exacerbate pressure on already strained rivers, aquifers, and water supplies in water-stressed regions. Analysis by Watershed Investigations found that over half of the 33 planned new or expanded mines designated as "strategic projects" under the EU's Critical Raw Materials Act are located in areas drying over the past two decades, according to Nasa satellite data. Nearly half are in zones experiencing drought conditions in the past three months, and a quarter are in regions deemed water-stressed. This is particularly concerning given the severe drought conditions in Europe, with Spain, Portugal, and Greece among the top 10 EU nations with the worst water scarcity. The Spanish region of Catalonia declared a state of emergency over its worst-ever drought in 2024, and water-use restrictions were imposed in Andalucía. The EU's decision to fast-track these mines through permitting processes and provide political backing and potential access to EU funding has alarmed environmental groups. The European Commission defended its choice of mines, citing independent expert assessments and compliance with EU environmental law. However, Sara Johansson, a water policy manager at the European Environmental Bureau, called the plans reckless, arguing that the mining industry has not presented evidence that the current water protections are creating bottlenecks. Prof Kaveh Madani, the director of the United Nations University Institute for Water, Environment and Health, warned against removing protections, stating that fast-tracking mining in water-stressed regions by weakening safeguards is akin to Russian roulette. He emphasized that one serious failure in the wrong location can neutralize promised economic gains and cause long-lasting or irreversible damage to people, rivers, aquifers, and ecosystems. Several companies disputed suggestions that their projects would place undue pressure on water resources, citing environmental assessments, closed-loop water recycling systems, monitoring programs, and regulatory oversight. However, the industry body Euromines, which has been pushing for changes to the water framework directive, insists that it is not a license to pollute and that it is committed to constructive engagement with policymakers to ensure strong environmental safeguards alongside legal clarity and predictability for permitting authorities.
