Hizb ut-Tahrir Ban: Australia's New Hate Laws in Action (2026)

Minister Unveils New Hate Laws: Hizb ut-Tahrir Banning Process Initiated

In a significant development, Home Affairs Minister Tony Burke has announced that the process to ban the Islamist group Hizb ut-Tahrir under new hate laws has commenced. This move comes as a response to the group's potential to spread hate, as identified by the ASIO (Australian Security Intelligence Organisation).

The new legal regime, established post the Bondi attack, aims to capture individuals deemed to spread hate, even if they don't meet the criteria for terrorist listings. Hizb ut-Tahrir, one of two primary targets, was deemed to meet the threshold for this new legal framework. The other group, the National Socialist Network, has already disbanded in January.

The next steps involve a departmental briefing to assess the group's risk of hate-motivated violence, followed by a briefing for the opposition leader and the attorney-general's approval for a ban. Minister Burke emphasized that the group's actions, rather than explicit calls for violence, were considered in this decision.

The laws, passed in January with Liberal Party support, faced opposition from the Nationals and Greens, who deemed the scope too broad. The minister also addressed criticism regarding a group of Australian citizens linked to former Islamic State fighters in Syria. Despite initial attempts to leave Syria, one woman received a temporary exclusion order, a measure to prevent her return due to security concerns.

The opposition questioned the necessity of further exclusion orders and the government's use of Passport Act powers. Minister Burke clarified that the group's members vary in risk assessment, with one individual posing a specific threat. He also denied reports of the government's communication with Kurdish authorities and meetings with state governments regarding repatriation, emphasizing the focus on security arrangements.
